(1) Purpose And Intent: The purpose and intent of this article is to establish uniform requirements governing dischargers into the POTW which enables the City to protect public health in conformity with all applicable City, State and Federal laws relating thereto which.
A. Prevent the introduction of pollutants into the POTW which would interfere with the normal operation of the POTW and/or would not receive adequate treatment or would pass through the system into the receiving waters or atmosphere or otherwise be incompatible with the system;
B. Improve the opportunity to recycle and reclaim wastewater and sludge from the system;
C. Ensure that the quality of the wastewater treatment plant sludge is maintained at a level which allows its use and disposal in compliance with applicable law;
D. Protect the health of the persons working with the POTW.
(2) Applicability:
A. This article shall apply to any user of the POTW. This article authorizes the issuance of wastewater discharge permits; monitoring, compliance, and enforcement activities; establishes administrative review procedures; requires user reporting; and provides for the setting of fees for the equitable distribution of costs for administering the programs established herein, and for the issuance of wastewater discharge permits and special agreements.
(3) Legal Authority:
A. This article is established pursuant to 40 CFR 403.8 (f)(1) and the laws of the United States of America and the State of Idaho; further pursuant to that authority vested in the City Council by the laws of the State of Idaho and vests authority to execute the laws and provisions herein in the Public Works Director and other so named and designated herein.
