§ 50.163 CRIMINAL PROSECUTION.
   (A)   Negligent violations.
      (1)   Any person who negligently violates any provision of this chapter or any orders or permits issued hereunder shall, upon his first conviction, be punished by a fine ranging from $2,500 to $25,000 per violation per day and/or imprisonment for not more than one year.
      (2)   Any person who negligently violates any provision of this chapter or any orders or permits issued hereunder shall, upon subsequent conviction, be punished by a fine of $50,000 per violation per day and/or imprisonment for not more than two years.
   (B)   Knowing violations.
      (1)   Any person who knowingly violates any provision of this chapter or any orders or permits issued hereunder shall, upon his first conviction, be punished by a fine ranging from $5,000 to $50,000 per violation per day and/or imprisonment for not more than three years.
      (2)   Any person who knowingly violates any provision of this chapter or any orders or permits issued hereunder shall, upon subsequent conviction, be punished by a fine of $100,000 per violation per day and/or imprisonment for not more than six years.
