905.02 DEFINITIONS.
   (a)    Right-of-way. The strip of land taken or dedicated for use as a public way. In addition to the roadway, it normally incorporates the curbs, lawn strips, sidewalks, lighting and drainage facilities, and may include special features (required by the topography or treatment) such as grade separation, landscaped areas, viaducts and bridges. The width of a right-of-way is measured as the perpendicular distance across a public street, measured from property line to property line. When property lines on opposite sides of the public street are not parallel, the right-of-way width shall be determined by the Village Engineer.
   (b)    Construction of or on any sidewalk, shared-use path, curb, curb and gutter, or driveway entrance within the public right-of-way or easement performed contrary to the provisions of this chapter, shall constitute a violation of this code and may be ordered stopped and or removed by the Mayor and/or his designee. The Mayor and/or his designee may order replacement of a sidewalk, shared-use path, curb, curb and gutter, or driveway entrance subsequent to such ordered removal. Sidewalk, shared-use path, curb, curb and gutter, and or driveway entrance removal and replacement shall be completed within thirty (30) days after receipt of such order.
