711.02 LICENSE REQUIRED.
   (a)   Any person, firm or corporation desiring to carry on mining operations by the stripping method shall first apply for a license therefor to the Mayor, which license may be issued by the Mayor with the consent of Council to the applicant upon his compliance with the restrictions and conditions as herein provided.
   (b)   No license shall be issued for strip mining operations, where the operations, are located in such proximity to streets, dwellings or other buildings, that it shall constitute a nuisance or annoyance to the general public, or where it can reasonably show that the same shall constitute a hazard to the safety of the traveling public or to residents located within dwellings or other buildings located within the general area of the mining operations.
   (c)   No license shall be issued unless there shall be such restoration or replacement, and it can be reasonably shown that there is in existence a plan for the restoration of the land which has been approved by the State Code of Ohio and that a license has been granted under the provisions of Ohio R.C. 1513.07 or such other sections of the law of the State of Ohio as may hereafter be relevant to the reclamation of strip mined lands.
   (d)   No license shall be issued unless it is shown that the applicant is in compliance with all the provisions of Ohio R.C. 1513.01 through 1513.99.
