1317.07 CONSTRUCTION CERTIFICATE.
   (a)   Prior to the construction, reconstruction, location, enlargement, erection, placement, change or remodeling of any primary residential structure, application shall be made to the Inspector for a construction certificate. The application shall indicate the exact location of the proposed construction, reconstruction, location, enlargement, erection or placement and plans and specifications showing proposed locations and dimensions of the structure. Within ten days after the receipt of the application, the Inspector shall issue a construction certificate. Provided the applicant has paid the required fee, which shall be nonrefundable, except in cases where construction is not commenced due to circumstances beyond reasonable control of the applicant. In such cases, all the required fee shall be refunded to the applicant except for twenty dollars ($20.00), which shall be retained as an administrative fee.
   (b)   In the event of an emergency, including fire, wind storm, flood or other act of God, which totally or partially destroys a primary residential structure or makes the same uninhabitable or unusable, this chapter may be temporarily suspended by the Inspector. The suspension of the Regulations shall not exceed six months from the date of the destruction or damage to the structure.
   (c)   No construction certificates shall be transferred to another person or to another lot.
   (d)   Construction certificates shall expire at the end of ninety (90) days from the date of issuance. If the construction, erection, location, enlargement, placement, change or remodeling of the structure is not commenced within the said ninety (90) day period, a new application accompanied by another nonrefundable fee shall be made to the Inspector. The owner or lessee, his agent or employee, shall be responsible for obtaining a construction certificate as required by this section. A violation of this requirement shall be enforceable against any of the aforementioned persons, corporations, partnerships, or associations, either by civil or criminal action, as provided by law.
   (e)   The following fees shall be paid prior to the issuance of a construction certificate. Such fees may be amended from time to time by majority vote of the Board of Housing Appeals.

   Persons in the business, either part or full time, of construction shall obtain a construction permit before new construction, additions, or alterations have been started. Such builders shall properly display the construction certificate in a manner which is clearly visible from the street.
   (f)   The above said fees shall be doubled when a construction certificate is applied for and issued after construction, additions or alterations have been started by the said builder.
   (g)   This chapter shall not be interpreted as amending, abrogating, or nullifying any ordinances, regulations, resolutions or permits previously adopted or issued by the Council of the Village of Cadiz, except for such ordinances, regulations, resolutions or permits as are in conflict with the chapter or amendments thereto, in which event, this chapter and amendments thereto shall prevail.
