1317.05 BOARD OF HOUSING APPEALS.
   (a)   Council, does hereby empower, authorize and direct the Board of Housing Appeals, in addition to and coincident with the authority and power granted to it in Ordinance 79-3, to conduct hearings and proceedings and make such orders as may from time to time be required by this chapter. The Board shall be constituted and organized as set forth in Ordinance 79-3. The compensation of the members of the Board for actions pursuant to this chapter shall be established by Council.
   (b)   The Board shall be empowered, authorized and directed to do the following:
      (1)   Hear and decide appeals where it is alleged that there is error in any order, requirement, decision, or determination made by an administrative official in the enforcement of this chapter or any resolution or ordinance adopted pursuant thereto.
      (2)   Authorize, upon appeal in specific cases, such variance from the terms of this chapter as will not be contrary to the public interest where just cause is clearly shown for such variance.
      (3)   Grant conditional construction certificates for the use of primary residential structures if such certificates for specific purposes are provided for in this chapter.
   (c)   In exercising the above mentioned powers, the Board may, in conformity with such sections, reverse or affirm, wholly or partially, or modify the order, requirement, decision or determination appealed from and may make such order, requirements, decision or determination as ought to be made and shall have all the powers of the officer from whom the appeal is taken.
