1117.07 MISCELLANEOUS LOT REGULATIONS.
   (a)   Stripping of Topsoil. No person, firm or corporation shall strip, excavate, or otherwise remove topsoil for sale, or for use other than on the premises from which the same shall be taken except in connection with the construction or alteration of a building on such premises and excavation or grading incidental thereto.
   (b)   Maintenance of Screening of Landscaping. Failure to maintain fencing or to replace dead or diseased landscaping shall be considered a violation of this Zoning Ordinance.

   (c)   Driveway Standards. 
      (1)   No curb opening shall be less than twelve feet in width, but in regards to residential properties having a two-car garage, an eighteen lineal foot curb opening shall be permitted. The maximum width of driveways serving one or two family residences shall be twenty-four feet.
      (2)   The maximum width of commercial and industrial development driveways shall be thirty-five feet.
      (3)   All driveways shall be extended from the street line across the private property line and continue into the private property as a driveway in accordance with the Planning and Zoning Code.
      (4)   All driveways shall be constructed with a six-inch thick plain concrete slab or a two-inch thick asphalt concrete surface course on a four-inch thick stone base, the kind of material and the construction specifications therefor subject to the approval of the Mayor or his designee. Unless specifically authorized, the driveway within the limits of the sidewalk shall be six-inch plain concrete only, for a minimum width of one foot beyond the driveway on each side, and must be effectively separated from the sidewalk by an expansion joint. The driveway shall be the same width at the curb line as the curb opening and not less than eight feet in width at the street side of the sidewalk.
      (5)   When and if any driveway is no longer used for driveway purposes, it shall be considered abandoned. The Village reserves and shall have the right to forthwith take the necessary steps to close the driveway, replace the curb and restore the pavement to its original condition. The owner of the property served by such driveway shall be notified by personal service or registered mail of the intention to close the driveway.
      (6)   After fifteen days from the date of notice, if the owner has failed to make the replacement or to contact the administrator, the administrator shall proceed with the work of restoring the curb and pavement to their original conditions. The cost of such work shall be charged against the abutting property and if not paid shall be certified to the proper taxing authority for collection in such manner as provided by law.
      (7)   Private driveway permit requirements. A Preliminary sketch on 8 ½ x 11" paper must accompany the completed form which shows:
         A.   The plan for drive.
         B.   The lots which will be served by the drive.
         C.   The acreage for each lot.
         D.   The names of the lot owners who will use the drive.
         E.   Show a lot number on each lot.
         F.   The public road which abuts the drive.
         G.   A profile of the drive is to be submitted with the preliminary sketch.
