(a) Connection to the Village’s water treatment system shall be performed exclusively by, or at the direction of, the Village and shall include such labor, equipment and materials as set forth in the appropriate Tap-in Fee Schedule. Hereinafter, said connection and all related parts shall be referred to as a tap-in or tap and said fees shall be referred to as tap-in fees or tap fees.
(b) The tap-in fees charged to customers outside of the corporate limits of the Village of Cadiz shall be as shown in Exhibit A, Tap-in Fee Schedule for Customers Outside the Corporate Limits of the Village of Cadiz, hereinafter “customers”. For purpose of this section, “customers” shall be defined as the person or persons owning the property for which water service is to be provided.
(c) The Village Administrator is hereby authorized to solicit new users in any areas currently served or which will be served by the Village’s water treatment system.
(d) As they pertain to water use by customers outside the corporate limits of the Village of Cadiz, the bylaws and/or rules and regulations of the Village are hereby amended to include the covenants, promises and agreements contained in the Water Users Agreement, as shown in Exhibit B, and that said Water Users Agreement shall constitute the Board’s policy governing the administration of water use outside the corporate limits of the Village of Cadiz.
(e) Customers desiring municipal water service shall enter into a Water Users Agreement with the Village, as shown in Exhibit B. The Village Administrator is hereby authorized to execute said Water Users Agreement and collect tap-in fees on behalf of the Village.
(f) Council hereby authorizes the Mayor to enter into such right-of-way easement agreements, as shown in Exhibit C, as the Mayor determines to be necessary to provide ingress and egress for the purpose of providing, maintaining and removing the water service, materials and equipment together with all rights necessary and appurtenant thereto.
(g) The Mayor is hereby authorized to offer, from time to time and for a period of time as the Mayor determines to be necessary, a preconstruction incentive to new customers in the form of a discount in the amount of three hundred dollars ($300.00) on the tap-in fees shown in the Tap- in Fee Schedule for Customers, Exhibit A.
