(a) No water or sewer service shall be furnished outside of the Village limits of the Village of Cadiz, excepting as follows:
(1) Water and/or sewer capacity that is declared to be “surplus” by resolution of the Village and then only as follows:
A. That said “surplus” (only) water and/or sewer capacity be furnished pursuant to a contract with the user thereof; said contract to be proposed by the Village Administrator authorized by the Village Council, and executed by the Mayor and the Village Administrator.
B. Under the rules and regulations of said water and/or sewer service, as may exist on file at the Village at the time of the passage of said regulation.
(2) To areas outside of the Village presently served by the Village under contractual arrangements thereto entered into with public bodies such as County Sewer and Water Districts, schools and other municipalities or political subdivisions.
(b) The price for said “surplus” water and/or sewer service shall be at an amount not less than that charged to the residents of Cadiz, Ohio, and for an additional percentage as shall be agreed upon by the parties.
