(a) Connection to the Village’s sanitary sewer system shall be made, without exception, if:
(1) A. The foundation of any structure with a need for sanitary sewer or sanitation service is situated within two hundred feet of any Village right of way for its sanitary sewer system; and
B. It is determined by a professional engineer that such connection can be accomplished.
(2) All sewer systems not in use after connection to the Village’s sanitary sewer system shall be abandoned pursuant to the statutes, rules and regulations of the State of Ohio and Harrison County.
(3) All residential, commercial or industrial structures who meet the criteria set forth in paragraph (1) hereof shall be charged a minimum fee equal to the current minimum sewer charge assessed by the Village, regardless of whether actual connection to the Village’s sanitary sewer system is made.
(b) Notice of the provisions of this section regarding the mandatory connection to the Village’s sanitary sewer system shall be sent to each owner required to perform the aforementioned hook-up by certified mail, return receipt requested.
(c) Each owner shall have thirty days from the date of the mailing of said notice to comply with the requirements of this section.
