(a) No person shall make any excavation, trench or other opening in any portion of any street, alley or other public right of way, including the sidewalk and/or treelawn area, or tunnel under such right of way, without first obtaining a permit therefor from the Mayor or his/her designee prior to the commencement of any work.
(b) Permits for emergency street openings shall be obtained as promptly as possible. Such permits shall be obtained, however, no later than the first working day after such emergency work is commenced.
(c) An applicant for such a permit shall file an application with the Mayor or his/her designee forty-eight hours prior to the beginning of the work, unless the work is of an emergency nature, in which case the application shall be made within the next working day. The period of time allowed for the closing of the opening will be governed by its size and nature, but in no case shall such period exceed fourteen days, unless otherwise approved.
(d) When paving of any kind, and/or any curb, sidewalk, driveway or treelawn area, has been disturbed by authority of a permit, the holder of the permit or his or her agents must make permanent repairs at his or her cost and expense. Said permittee is required to notify the Street Department of the exact date upon which the opening is to be made and also prior to and upon completion of the permanent repairs, at which time a final inspection of the work will be made.
(e) If the permittee at any time fails to maintain the work as required, the Street Department Superintendent will immediately notify the permittee. If, after notification, the permittee fails to commence the repairs forthwith, the Street Department Superintendent shall have the right to cause said repairs to be made, the cost thereof to be billed to the permittee. In any event, if an exceedingly dangerous condition is found, the Superintendent may make emergency repairs, the cost of which shall be billed to the permittee.
