§ 152.108 ADMINISTRATION.
   (A)   Powers and duties of the Board of Adjustment.
      (1)   The City Council shall act as the Board of Adjustment for the City of Byron for the purposes of this chapter.
      (2)   The Board of Adjustment shall act upon all questions as they may arise in the administration of this chapter, including the interpretation of zoning district boundaries, appeals of decisions of the Zoning Administrator, and variances.
   (B)   Violations. Any structure or use erected, altered, or maintained in violation of this chapter is declared unlawful. In the event of a violation or threatened violation of this chapter or other official control adopted under M.S. § 462.351 through 462.365, the Zoning Administrator or their designee may institute appropriate actions or proceedings to prevent, restrain, correct, or abate such violation or threatened violations.
   (C)   Complaints regarding violations. Whenever a violation of this chapter occurs, or is alleged to have occurred, any person may file a written complaint. Such complaint shall state fully the causes and basis thereof and shall be filed with the Zoning Administrator. The Zoning Administrator shall record properly such complaint, investigate in a timely fashion, and take action thereon as provided by this chapter. The person(s) filing the complaint shall remain confidential as required by state law.
   (D)   Administrative action for violations. If the Zoning Administrator finds that any of the provisions of this chapter are being violated, he or she shall notify in writing the person responsible for such violations indicating the nature of the violation and ordering the action necessary to correct it. He or she shall order discontinuance of the legal use of land, buildings or structures; removal of illegal buildings or structures or of illegal additions, alterations or structural changes; discontinuance of any illegal work being done; or shall take any other action authorized by this chapter to ensure compliance with or to prevent violation of its provisions.
   (E)   Penalty. Any person, firm, corporation, or entity who violates any of the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction, be punished as provided in § 10.99. Each day that a violation is committed or permitted to exist shall constitute a separate offense. The imposition of any fine or sentence shall not exempt the offender from compliance with the requirements of this chapter, and the city may pursue, by appropriate actions or proceedings, any or all additional other remedies.
