§ 152.101 SITE PLAN REVIEW.
   (A)   Purpose. Site plan review is required to allow the city to review the proposed site plan for conformance with this chapter. Site plan review shall be required for all new construction.
   (B)   Site plan review may be part of a building permit approval process, or may be included as part of the review process for other requests, such as conditional use permits, variances, or plats.
   (C)   Procedure.
      (1)   The Zoning Administrator shall review the site plan request and approve or deny the application administratively. The Zoning Administrator shall state in writing his or her findings for approval or denial.
      (2)   The Zoning Administrator may choose to refer site plans to the Planning Commission and City Council for review. If the site plan is referred to the Planning Commission and City Council, the Council shall make the final decision.
   (D)   Once the site plan has been approved as herein provided and the use is established, accessory structures or uses meeting all other requirements of this chapter may be permitted without Planning Commission review, whether or not such proposals are consistent with the approved site plan.
   (E)   Expiration.
      (1)   The approved site plan shall expire within 12 months of approval unless a building permit for the property has been obtained.
      (2)   The approved site plan shall expire within 24 months of approval if the structure has not been substantially completed. SUBSTANTIAL COMPLETION is defined as the point in time when the structure has been completed to the point where it may be used for its intended purpose.
      (3)   If the approved site plan expires before work on the structure is complete, the applicant shall reapply for site plan review before commencing work on the structure.
   (F)   Amendment. Where further construction occurs on the property that increases the total amount of floor area of the use, including accessory structures, by 20% or more or where such proposals are not consistent with the approved site plan, the property owner shall be required to submit for review by the Planning Commission an amended site plan.
