905.02  EXCAVATION; PERMIT; BOND; SPECIFICATIONS.
   (a)   No person, firm or corporation shall dig, cut, open, excavate or trench any public street, alley, right of way or easement of the Village without a permit therefor and without compliance with the regulations hereinafter set forth.

   (b)   A permit pursuant to this section shall be issued by the Fiscal Officer upon the payment of a fee of two hundred fifty dollars ($250.00).

   (c)   The Fiscal Officer shall establish standard specifications for restoration of public property, for providing adequate protective devices and traffic controls, and for general procedures in crossing paved streets.
      (1)   The repair to the street or alley shall be under the supervision of the Street Superintendent.
      (2)   The repair of streets shall meet one of the following standards:
         A.   Two inches of asphalt (404) shall be placed on top of six inches of concrete (452), both of which shall be one foot wider on each side than the pipe trench.  The pipe trench shall be backfilled with compacted dirt at least six inches above the pipe and granular backfill to the bottom of the concrete.  Cold-mix may be used temporarily until asphalt is available.
         B.    Eight inches of concrete which shall be one foot wider on each side than the pipe trench. The pipe trench shall be backfilled with compacted dirt at least six inches above the pipe and granular backfill to the bottom of the concrete. Cold-mix may be used temporarily until concrete is available.
      (3)    The repair at alleys shall meet the following standard:
         A.    Two inches of asphalt (404) shall be placed on top of six inches of mechanically compacted subbase (310). The pipe trench shall be backfilled to the bottom of the subbase with compacted granular backfill.
      (4)    Should the alley or street be unpaved the compacted dirt shall be placed at least six inches above the pipe with the balance of the fill to be of crushed stone.
   (d)    No cuts shall be made in any paved street or alley within three years after the surfacing thereof, except as specifically authorized by the Fiscal Officer, providing, however, that at least ninety days prior to the paving or resurfacing of any street or alley with concrete or asphaltic concrete (404 or equivalent), a notice shall be mailed to the property owners indicating that the paving or resurfacing will be done and advising such property owners that no pavement cuts shall be permitted for three years after such resurfacing or paving is completed except in cases of emergency.

   (e)    The provisions of this section do not apply to emergency excavations by the Water or Sewer Department of the Village, but such Department shall be charged for the cost of repairing any street so excavated.
