521.11  RESTRICTIONS ON WATER USE.
   (a)    The Mayor is hereby authorized, during times of water shortage in the Village, to issue on behalf of the Village, an Order restricting or curtailing the use of water during the existence of the shortage. The Mayor shall consult with the Water Superintendent prior to his determination of a water shortage and the issuance of the Order.  Such Order shall be given by proclamation, signed by the Mayor, and shall be posted in the places and manner that ordinances are posted within the Village, and shall be published as soon as practicable in a newspaper of general circulation within the Village. The Mayor may amend or modify the Order during the time of the shortage, as the need arises. Such amendments or modifications of the Order shall be published and posted as previously provided herein. After any such Order, or amendments or modifications thereto, have been proclaimed and published as herein provided, no person shall violate the provisions thereof.
   (b)    In the proclamation, the Mayor shall indicate the nature of the water shortage, the types of water uses which are restricted or curtailed, and the length of time in which the Order shall be in effect.
   (c)    The Mayor is authorized, after consultation with the Water Superintendent, to order restrictions or curtailment of any or all of the following types of water uses:
      (1)    Watering of lawns, trees, shrubbery and gardens.
      (2)    Washing of vehicles.
      (3)    Use in air conditioning systems.
      (4)    Use in swimming pools.
      (5)    Moratorium on all new water taps for all types of uses, including residential construction within the water system.
      (6)    Industrial use of water in industries using water in the actual production of such industries exclusive of minor clean up and sanitary use incidental to the operations.
      (7)    Industrial and commercial use for all other purposes.
   (d)    Whoever violates this section shall be guilty of a misdemeanor of the third degree. Each day of violation shall constitute a separate offense. If a water user violates this section more than once during a declared water shortage, the Mayor is authorized to order the water service of such water user to be terminated immediately and without further notice. Such service may be resumed only upon payment to the Village by the water user of a fee of one hundred dollars ($100.00) for shutting off the service, and an additional fee of one hundred dollars ($100.00) for turning on the service, as well as all current and delinquent charges of any nature whatsoever due the Village on such account. Such service, once terminated, need not be restored until the period of water shortage is over.
