521.03  UNCOVERED OR ABANDONED WELLS AND CISTERNS;  NUISANCE ABATEMENT; EXCAVATIONS MUST BE BARRICADED.
   (a)   All abandoned or uncovered wells and cisterns shall be filled or suitable covers placed thereon.  All excavations caused either by the razing of dwellings or structures or any depression where surface water collects shall be declared a nuisance.  Upon notice to the Fiscal Officer that a cistern or well, excavation or pool of water has been either abandoned or left unattended by a property owner, the matter shall be referred to the Street Committee of the Village, which upon investigation, shall report to Council.
   If Council believes and declares by resolution that the abandonment is a nuisance, a copy of the resolution together with a notice shall be sent to the property owner.  If he is not found, publication of the notice for one week in a paper of general circulation in the County shall be deemed sufficient notice.  The notice shall contain with the resolution, an order for the property owner to correct the nuisance within thirty days.  If the nuisance is not corrected it shall be corrected by the Village at the owner’s expense.  The expense shall include the costs of publication and service and shall be certified to the Auditor of the County to be placed on the tax duplicate.
   All open excavations shall be suitable barricaded with a fence of sufficient height, at least five feet high around the excavation.

   (b)   Whoever violates this section is guilty of a minor misdemeanor.
