509.08  CURFEW.
   (a)   No person having the control and custody of or being the parent or guardian of a minor under the age of eighteen years shall permit such minor to, nor shall such minor, be outside the confines of his home site and congregate, wander, loiter or play upon the streets and other public places of the municipality, unsupervised or unenclosed lands, or places of amusement and entertainment after the hours of 11:00 p.m. on Sunday through Thursday of each week, and after the hours of 11:30 p.m. on Friday and Saturday of each week.

   This section shall not apply to a minor:
      (1)   On an emergency errand or on legitimate business as directed by the parent, guardian or custodian provided such direction is in writing and in the possession of the minor;
      (2)   Accompanied by the parent, guardian or custodian or some other person over twenty-one years of age who has been given responsibility for the discipline of the minor;
      (3)   On his way to or from a sponsored school function or a sports event provided it is no later than one-half hour after its termination;
      (4)   Going to and from work where legally employed or when making trips or errands from such place of employment at the request of the employer.
   
   (b)   Whoever violates this section shall be fined fifteen dollars ($15.00) for the first offense, twenty-five dollars ($25.00) for the second offense and fifty dollars ($50.00) for each offense thereafter.  (Ord. 938.  Passed 1-12-76.)
