123.02  USE AND SALE OF CODIFIED ORDINANCES.
   (a)   As the effective date of this section, all fifty volumes of the Codified Ordinances of Byesville, Ohio, including all annual supplements, shall be considered Village property, unless legally and properly sold as further provided herein.
   (b)   The following Village officials shall be entitled to the use of one Codified Ordinance Book, with the annual supplements, as long as that person legally remains as an official of the Village:
      (1)   Village Solicitor.
      (2)   Mayor.
      (3)   Fiscal Officer.
      (4)   Income Tax Clerk.
      (5)   Council Members.
      (6)   Village Administrator.
      (7)   Street Department Superintendent.
      (8)   Water Department Superintendent.
      (9)   Police Chief.
      (10)   Water Clerk.
   (c)   If any of the aforesaid persons leave or is removed from office, then he or she shall return the Codified Ordinance Book and all supplements in their possession to the Fiscal Officer.  If any of the aforesaid persons dies in office, then his or her heirs or legal representative shall return the Codified Ordinance Book and all supplements in their possession to the Fiscal Officer.
   (d)   If the Codified Ordinance Book with all supplements is not returned after written demand by the Fiscal Officer or Village Solicitor, then that person or their heirs or legal representative shall be charged the sum of fifty dollars ($50.00) for the Codified Ordinance Book and supplements, which sum shall be payable to the Fiscal Officer on behalf of the Village.
   (e)   The Fiscal Officer is hereby authorized and directed to number each of the Codified Ordinance Books and to maintain a log of all persons who have been issued a Book and supplements for the same.  The Fiscal Officer is further authorized to sell twenty-five Ordinance Books for the sum of fifty dollars ($50.00) for hard bond volumes and fifty dollars ($50.00) for soft bond volumes.  All funds so received by the Fiscal Officer shall be deposited in the Village General Fund.
   (f)   The Fiscal Officer is further authorized and directed to deliver current issues of the Codified Ordinances of Byesville, Ohio with supplements to the Guernsey County Public Library, the Guernsey County Law Library and the Municipal Court free of charge.
