THE EXISTING LAND DEVELOPMENT ORDINANCE WITH NON SUBSTANTIVE CHANGES AND ORDERING THE PUBLICATION THEREOF

THE RESTATEMENT OF THE EXISTING LAND DEVELOPMENT ORDINANCE WITH NON SUBSTANTIVE CHANGES AND ORDERING THE PUBLICATION THEREOF
WHEREAS, the Butner Town Council has requested that staff conduct a review of the Land Development Ordinance (LDO) of the Town of Butner for the purpose of formal publication of the existing Land Development Ordinance; and
WHEREAS, the Town staff has identified and recommended to the Town Council the Ordinance Changes described below; and
WHEREAS, the Town is empowered, authorized and/or required to adopt ordinances necessary to protect the health, safety, and welfare of its citizens pursuant to the laws of the State of North Carolina and is required to adopt and issue a code of its ordinances pursuant to N.C. Gen. Stat. § 160A-77.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL FOR THE TOWN OF BUTNER, NORTH CAROLINA, NORTH CAROLINA AS FOLLOWS:
Section 1. The Land Development Ordinance of the Town of Butner as restated and compiled in book form are hereby adopted as and shall constitute the “Land Development Ordinance of the Town of Butner, North Carolina”.
Section 2. Such LDO as adopted in Section 1 shall consist of the following Titles:
Tree Preservation and Protection
Review and Approval Procedures
Off-Street Parking, Loading, and Stacking Requirements
Flood Damage Prevention
General Development Standards
Section 3. Such LDO shall make such technical, non-substantive changes as necessary to provide for current statutory references, correct grammatical and punctuation errors.
Section 4. Such LDO is hereby adopted with such technical corrections described above. Except for such technical corrections, the existing LDO previously adopted are reaffirmed, republished, and restated in their entirety and such technical corrections shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this LDO, nor shall such, technical corrections affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the LDO.
Section 5. Such LDO shall be deemed published as of the day of its adoption and approval by the Butner Town Council and the Clerk of the Town of Butner is hereby authorized and ordered to file a copy of such Land Development Ordinance in the Office of the Clerk and the office of the Planning Department.
Section 6. Such LDO shall be in full force and effect as of the day of its adoption and approved by the Butner Town Council, and such LDO shall contain a statement that it is published by order of the Town Council and shall be presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties and regulations therein contained and of the date of passage, and that the same is properly signed, attested, and recorded in the meeting minutes of the Butner Town Council.
