For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
“DEPARTMENT.” An employee, police officer, City Planner, Clerk-Treasurer, City Attorney, Code Enforcement Officer, Superintendent of Utilities, or Superintendent of Streets of the City of Butler, or their designee, who serves or posts any notice authorized by this chapter.
“OWNER.” Any one or more of the following:
(1) The fee simple owner or owners of a parcel of real estate including the life tenant or tenants if any;
(2) The record owner or owners as reflected by the most current records in the DeKalb County Auditor's office; or
(3) The purchase or purchasers of such real estate under any contract for conditional sale thereof.
“WEEDS OR OTHER RANK VEGETATION.”
(1) Includes the following:
(a) All plants set forth in IC 15-16-7-2 or plants that are poisonous or detrimental to human health or have been determined to be noxious by the Indiana legislature or by rule of the Indiana Department of Natural Resources or Indiana Department of Agriculture; and
(b) Grass, plants, or other rank vegetation in excess of eight inches tall, other than trees, bushes, flowers, other ornamental plants, or agricultural plants.
(2) Weeds or other rank vegetation does not include:
(a) Wetlands;
(b) Woods;
(c) Nature preserves;
(d) Undeveloped areas;
(e) Storm water best management practice areas;
(f) Agricultural crops such as hay and pasture;
(g) The banks of streams and open drains; or
(h) Areas maintained in their natural state in public parks and outdoor nature laboratories maintained by schools.
