505.09 BARKING OR HOWLING DOGS; NUMBER OF DOGS PERMITTED.
   (a)   No person shall keep or harbor any dog within the Municipality which, by frequent and habitual barking, howling or yelping, creates unreasonable loud and disturbing noises of such a character, intensity and duration as to disturb the peace, quiet and good order of the Municipality. Any person who shall allow any dog habitually to remain, be lodged or fed within any dwelling, building, yard or enclosure, which he occupies or owns, shall be considered as harboring such dog. Such dogs are hereby declared to be a public nuisance, subject to abatement in the manner provided by the Ohio Revised Code or by the Codified Ordinances.
   (b)   In all areas of the Village other than property utilized for Multiple Family Dwellings pursuant to R-3 of the Village Zoning Code and Multiple Family Dwellings held in condominium ownership pursuant to R-4 of the Village Zoning Code, no person shall own, keep or harbor more than two dogs, except a litter of puppies under five months old, in or on the premises of any dwelling unit within the Village, unless the zoning lot upon which dogs are kept have a minimum of 10,000 square feet for each dog kept on such zoning lot regardless of the number of person keeping or harboring dogs on such lot. In those portions of the Village wherein property is utilized for Multiple Family Dwellings pursuant to R-3 of the Village Zoning Code and Multiple Family Dwellings held in condominium ownership pursuant to R-4, no person shall own, keep or harbor more than one dog in a single dwelling unit, excepting a litter of puppies under five months old, regardless of the size of the zoning lot where such dwelling unit is located. A violation of this section constitutes a public nuisance subject to abatement in the manner provided by the Ohio Revised Code or by the Codified Ordinances.
   (c)   Whoever violates subsection (a) hereof is guilty of a minor misdemeanor. Whoever violates subsection (b) hereof is guilty of a minor misdemeanor and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. (Ord. 1299- 83. Passed 11-21-83.)
