(a) In the event the Zoning Inspector or Village Engineer finds that any improvements are being made to any land subject to this chapter in violation of the approved Grading Plan conditions, or the approved Plot Plan, or any regulations set forth in this chapter, the Zoning Inspector or Village Engineer shall give written notice to the person, firm, or entity responsible for construction of such improvements, notifying them of the violation of this chapter or of the Plan approval conditions. The Zoning Inspector or Village Engineer may issue a Stop Work Order or an adjudicative order and take such other legal or equitable action to enjoin any further construction of improvements upon any land where land disturbance has occurred.
(b) In the event the status of the improvement activity at the time such Stop Work or adjudicative order is issued is such as to create a risk of probable adverse environmental impact or erosion harm, the Village Engineer may require the applicant, or the owner if different from the applicant, to immediately undertake sufficient remedial measures to prevent such impact or harm. Such remedial measures shall be as prescribed by the Village Engineer.
