1347.04 APPEAL TO PLANNING COMMISSION.
   (a)    Upon submission of the six copies of the Grading and/or Plot Plan to the Planning Commission, and any required deposit, the Commission shall review such Plan(s) and any recommendations or comments by the Village Engineer at its next regularly scheduled meeting. The Commission shall consider the severity of any potential impact of erosion and/or siltation upon neighboring properties, the impact of drainage upon any building or structure proposed to be constructed, the recommendations of the Engineer, the costs of any proposed erosion control devices compared to the benefits to be obtained therefrom, the County Regulations, and shall approve or disapprove such Plan as submitted or amended within thirty days. The Planning Commission shall not approve any plans unless it is satisfied the Plan demonstrates the proposed improvements shall not significantly adversely impact the surrounding properties through erosion or siltation, and any building or structure proposed to be constructed shall not be subject to adverse drainage consequences, and that the County Regulations will be met.
   (b)    Such approval by the Planning Commission may include a requirement of a date certain in which permanent vegetation shall be installed upon all disturbed land. (For the purpose of this chapter, “permanent vegetation” means the installation of grass seed, grass sod, or other ground cover installed with the intent to be permanently placed on the ground and providing erosion and/or sedimentation control over the land to be covered.)
   (c)    The Planning Commission may also condition its approval of any Plan upon a deposit by the applicant in cash or surety bond in an amount not to exceed twenty-five hundred dollars ($2,500), intended to ensure that all erosion control devices, including permanent vegetation, as required by any Plan are properly installed. Any deposit so required shall not be released to the applicant until the Village Engineer is satisfied that all required soil and erosion control devices have been installed and all other conditions of approval have been met by the applicant.
 
   (d)    After such Planning Commission approval, the applicant may proceed in accordance with such approved Plan(s).
