931.01 UTILITY APPROVAL PROCEDURE.
   (a)    There is hereby established within the Village a utility approval procedure, as follows: Prior to taking occupancy of any dwelling or structure within the Village that requires sewer and/or water, the prospective applicant shall make application to the Clerk of the Board of Trustees of Public Affairs for approval of such utilities. Within forty days of the receipt of such application by the Clerk, the Board shall either approve, disapprove or conditionally approve the application. In the event of disapproval or conditional approval, the prospective applicant shall not take occupancy of the subject premises until either:
      (1)    Approval is granted via a subsequent application; or
      (2)    The conditions specified by the Board are met to the satisfaction of the Board.
   The Board shall appoint an inspector to inspect the applicant's premises, and he shall inform the Board of his findings within the forty day period. Should the Board approve the application, a certificate of approval shall be issued to the applicant, and the applicant may thereafter occupy the subject premises. The fee for such an application shall be twenty dollars ($20.00) per dwelling unit or structure.
   (b)    The Board may, from time to time, adopt policies and procedures relating to the utility approval procedure, but such policies and procedures shall not be in conflict herewith.
