For the purpose of this subchapter, manufactured homes will be regulated by type. Two types of homes are defined under these regulations.
(A) Type one manufactured homes shall:
(1) Have more than 1,200 square feet of occupied space in a double section or larger multi- section unit;
(2) The running gear and hitch have been removed;
(3) Have been anchored to a foundation and permanent footing. The foundation shall be an approved wood basement constructed of two-by-six framework and treated with water-resistant materials; or, a foundation shall be constructed with eight inches of poured concrete or concrete block. The footing to be a minimum of eight inches thick by 16 inches wide poured concrete, with top of footing to be six inches below grade;
(4) Prior to placement of a home on the foundation, it must be inspected and approved by the City Council and/or Superintendent of Utilities;
(5) Have a gabled roof with a pitch of at least two-twelfths’ pitch;
(6) Have vinyl or wood lap siding material of a type customarily used on site-constructed residences;
(7) Have roofing material of a type customarily used on site-constructed residences; and
(8) The age of the manufactured house may not exceed three years from the date of manufacture; or, if the manufactured house is over three years old from the date of manufacture, the house owner must first provide pictures of the house and get approval from the City Council.
(B) Type two manufactured homes shall:
(1) Have more than 700 square feet of occupied space in a single, double, expand, or multi-sectional unit;
(2) Utilize a permanent perimeter enclosure in accordance with approved installation standards, as specified in division § 151.03(B) (skirted);
(3) Be anchored to the ground, in accordance with manufacturer’s specifications, or as prescribed by the TR-75, issued June 1972, by the United States Department of Defense or by the ANTI/NFPA 501A standards;
(4) Have siding materials of a type customarily used on site-constructed residences;
(5) Have roofing materials of a type customarily used on site-constructed residences;
(6) The age of the manufactured house may not exceed ten years from the date of manufacture; or, if the manufactured house is over ten years old from the date of manufacture, the house owner must first provide pictures of the house and get approval from the City Council; and
(7) Be placed onto a support system, in accordance with approved installation standards, as specified in this section.
(C) A manufactured home placed and maintained on a tract of land and deemed to be a legal nonconforming use prior to the adoption of this subchapter shall continue to be a legal nonconforming use. If the nonconforming use is discontinued for a period of one year, the land thereafter must be used in conformity with all provisions of this subchapter.
