Section 13. CONSTRUCTION OF SIDEWALKS AND CURBS, ASSESSMENTS.
   The City of Burkburnett shall have the power to provide for the construction and building of such sidewalks, and to charge the entire cost of construction of such sidewalks, including the curbs, against the owner of the abutting property and to make a special charge against the owner for such cost and to provide by special assessment a lien against such property for such costs. Should any person or corporation owning land in the City of Burkburnett fail or refuse to construct sidewalks and curbs, in front of or abutting on their property, in accordance with this Charter, or any ordinance now in effect in this city, or any ordinance passed by the governing body under this or any other power conferred by this Charter, the city shall have the right to have sidewalks or curbs, both or either, constructed in accordance with such ordinances at the expense of the abutting property owner, and in addition to fixing a lien against the property for the expense thereof, may also recover a personal judgment against such abutting owner in any court having competent jurisdiction of the amount, for the cost and expense in constructing such sidewalks and curbs, with ten percent additional for attorney's fees.
