(A) A person commits an offense if the person owns, leases, keeps, possesses or maintains a kennel which does not meet the following requirement: it shall be more than three hundred (300) feet from any residence or habitation for human beings (other than the residence of the owner, lessor, keeper, or possessor of such kennel). The foregoing distance requirement shall be determined by measuring the most direct line between the two (2) structures.
(B) This section shall not apply to a kennel in existence and operated on the date this chapter is adopted so long as such kennel is hereafter operated continuously and without interruption.
