909.07 APPROVED TREE LIST AND PROHIBITED PLANTINGS IN OR ADJACENT TO THE PUBLIC WAY.

   (c)   Trees Prohibited in Public Way Areas (Prohibited Street Trees). These are weak, messy, destructive, disease or insect prone, and/or are invasive pests.
      (1)   No silver maple, poplar, box elder, basswood, willow, varieties of thorn trees, catalpa or Callery pear and cultivars of Callery pear shall henceforth be permitted to be planted upon any tree lawn in the City.
      (2)   Any silver maple, catalpa, poplar, basswood, box elder or willow upon private property in the City in such close proximity to any public place in the City as will permit the roots of the tree to penetrate through or under the surface of any public place in the City, is declared to be a public nuisance and shall be abated by the Service-Safety Director.
   (d)   Prohibited Manipulations of Plantings in or Adjacent to the Public Way.
      (1)   Espaliers or topiary: Forms achieved through trimming or pruning that are distorted or contrary to the natural shape of the species.
      (2)   Shrubs: Shrubs that typically grow taller than three feet, yet not tall enough to be under trimmed to a height of six feet.
      (3)   Topped or dehorned trees: Trees with most of or the entire crown removed.
   (e)   The plantings listed in subsections (a) through (d) above may be modified or revised from time to time upon the approval of the Tree City USA Board and the written approval of the Service Safety Director's designee. (Ord. 5-2023. Passed 3-7-23.)
