931.02 COLLECTION PROVISIONS.
   (a)   The City shall collect the garbage and rubbish from all domestic and commercial premises in the City, except as herein otherwise provided. Garbage and rubbish shall be collected at least once each week.
   (b)   (EDITOR’S NOTE: Former subsection (b) hereof was repealed by Ordinance 36-2002, passed September 17, 2002.)
   (c)   The Service-Safety Director shall cause all garbage and rubbish collected to be hauled to the county sanitary landfill or any sanitary landfill approved by the Ohio EPA for disposal of solid waste. It shall be his further duty to cause all vehicles and containers used for the removal of garbage and rubbish to be washed and disinfected at such times as may be necessary to prevent such vehicles and containers from becoming a nuisance or danger to the public health. Such vehicles and containers shall have steel bodies and watertight compartments with lids or covers rightly covering same. The covers on all commercial dumpsters or containers shall be kept in a closed position at all times when not in use.
   (d)    No person other than the City and private haulers shall transport, remove or haul any garbage and rubbish over or through any of the streets or alleys of the City. City residents are authorized to transport, remove or haul garbage and rubbish from their own premises to the county landfill as long as current City garbage rates are paid to the City.
   (e)    Each householder, except as herein otherwise provided, shall procure and keep available for the exclusive use on such premises, or the part thereof occupied by the householder, metal, plastic or vinyl containers of not less than ten-gallon nor more than forty-five gallon or thirty-five pound capacity to hold all the garbage accumulated thereon for the period of one week between collections and pending its removal by the garbage collector. Such containers shall be watertight with tightfitting lids, and shall be provided with a bail or handles. Such containers shall be kept in a clean and sanitary condition, being disinfected when required. Such containers shall have the house number clearly printed on container and lid positioned so as to be easily accessible to and for the garbage collector, but not within the limits of the street or other public place. The garbage shall be drained of liquids and be wrapped in paper before the same is deposited in the container for collection. The City will not assume any responsibility for damage to containers.
   (f)   All household rubbish and trash shall be placed in metal or plastic containers or plastic bags not to exceed forty-five gallons or thirty-five pounds. A monthly garbage and rubbish fee will consist of no more than six metal or plastic containers or plastic bags or the combination of no more than six containers or bags per week. Residents shall not put garbage bags or containers out more than twenty-four hours prior to the established pick-up date. Cardboard boxes will be picked up only if they are empty. An additional fee of two dollars ($2.00) shall be charged for each container or bag which violates the weight limit, however such additional fee shall not exceed five dollars ($5.00) per weekly pick up. An additional fee of one dollar ($1.00) shall be charged for each container or bag in excess of six. A fee of two dollars ($2.00) shall be charged for each container or bag in excess of twelve. A one dollar ($1.00) fee shall be charged for each container or bag of grass clippings or yard waste. Under no circumstances will grass clippings or yard waste be included in the six containers or bags of household garbage.
   (g)   Rubbish and trash and tree limbs and brush, too large to be placed in containers, must have special pick up arrangements made by contacting the Public Service-Safety Director. Additional changes will be made depending on weight and volume.
   (h)   No paint, paint thinners, alcohol byproducts, containers used with the foregoing products, or used automotive batteries will be collected in connection with the City rubbish collection service.

   (i)   From the time a resident places recyclable items at the curbside or street line for collection by City Service Department personnel, such recyclable items shall become the property of the City. It shall be a violation for any person unauthorized by the City to collect or pick up, or cause to be collected or picked up, any such item, and each such collection or pickup in violation hereof from any residence location shall constitute a separate and distinct offense punishable as a minor misdemeanor upon the first conviction and as a fourth degree misdemeanor for each succeeding conviction.
