931.01 DEFINITIONS.
   As used in this chapter:
   (a)    "Householder" means the head of a family or one maintaining his separate living room or quarters on domestic premises, including owners, tenants and other occupants.
   (b)    "Garbage" means all putrescible waste, including kitchen refuse, vegetable discard, and animal offal and refuse or anything whatsoever that may decompose and become a nuisance or a danger to public health.
   (c)    "Rubbish" means any paper, boxes, cans, bottles, articles of apparel, and all other forms of discarded material.
   (d)    "Director" means the Service-Safety Director of the City.
   (e)    "Collecting agent" means each and all employees of the City charged with the duty of collecting or receiving fees, or both, for collecting and disposing of garbage or rubbish.
   (f)   "Garbage collector" means the City of Bucyrus and each and all of its duly authorized agents or employees connected with the collection and disposal of garbage.
   (g)   "Rubbish collector" means the City of Bucyrus and each and all of its duly authorized agents or employees connected with the collection and disposal of rubbish.
   (h)   "Private collector" means anyone who is authorized to collect rubbish or garbage for a profit in the City of Bucyrus.
   (i)   "Domestic premises" means all premises used for dwelling premises, including single-family dwellings, two-family dwellings, apartments and apartment houses, trailers or any other accommodation used for dwelling purposes, where garbage or rubbish is or may be created, except hotels, motels, tourist courts and similar establishments. When domestic and commercial premises are located in the same building, the provisions of this chapter shall apply thereto as if they occupied separate premises.
   (j)   "Commercial premises" means all other premises in the City not hereinbefore defined as domestic, including institutions, both private and public, charitable and noncharitable, where garbage or rubbish is or may be created.
   (k)   "Used building materials" means any materials such as wood, stone, brick, cement block, vinyl, plastics, steel or alloy or any other composition thereof used or useful in the erection of any building or structure, which have been used previously for such erection or construction by the same persons or by any other person.
   (l)   "Automobile parts" means any portion or parts of any motor vehicle as detached from the vehicle as a whole.
   (m)   "Scrap metal" means pieces of parts of steel, iron, tin, zinc, copper, aluminum or any alloy thereof, whether covered with porcelain or any other material, whether intact or in parts, which has served its usefulness in its original form and can no longer be used for its originally intended purpose.

931.02 COLLECTION PROVISIONS.
   (a)   The City shall collect the garbage and rubbish from all domestic and commercial premises in the City, except as herein otherwise provided. Garbage and rubbish shall be collected at least once each week.
   (b)   (EDITOR’S NOTE: Former subsection (b) hereof was repealed by Ordinance 36-2002, passed September 17, 2002.)
   (c)   The Service-Safety Director shall cause all garbage and rubbish collected to be hauled to the county sanitary landfill or any sanitary landfill approved by the Ohio EPA for disposal of solid waste. It shall be his further duty to cause all vehicles and containers used for the removal of garbage and rubbish to be washed and disinfected at such times as may be necessary to prevent such vehicles and containers from becoming a nuisance or danger to the public health. Such vehicles and containers shall have steel bodies and watertight compartments with lids or covers rightly covering same. The covers on all commercial dumpsters or containers shall be kept in a closed position at all times when not in use.
   (d)    No person other than the City and private haulers shall transport, remove or haul any garbage and rubbish over or through any of the streets or alleys of the City. City residents are authorized to transport, remove or haul garbage and rubbish from their own premises to the county landfill as long as current City garbage rates are paid to the City.
   (e)    Each householder, except as herein otherwise provided, shall procure and keep available for the exclusive use on such premises, or the part thereof occupied by the householder, metal, plastic or vinyl containers of not less than ten-gallon nor more than forty-five gallon or thirty-five pound capacity to hold all the garbage accumulated thereon for the period of one week between collections and pending its removal by the garbage collector. Such containers shall be watertight with tightfitting lids, and shall be provided with a bail or handles. Such containers shall be kept in a clean and sanitary condition, being disinfected when required. Such containers shall have the house number clearly printed on container and lid positioned so as to be easily accessible to and for the garbage collector, but not within the limits of the street or other public place. The garbage shall be drained of liquids and be wrapped in paper before the same is deposited in the container for collection. The City will not assume any responsibility for damage to containers.
   (f)   All household rubbish and trash shall be placed in metal or plastic containers or plastic bags not to exceed forty-five gallons or thirty-five pounds. A monthly garbage and rubbish fee will consist of no more than six metal or plastic containers or plastic bags or the combination of no more than six containers or bags per week. Residents shall not put garbage bags or containers out more than twenty-four hours prior to the established pick-up date. Cardboard boxes will be picked up only if they are empty. An additional fee of two dollars ($2.00) shall be charged for each container or bag which violates the weight limit, however such additional fee shall not exceed five dollars ($5.00) per weekly pick up. An additional fee of one dollar ($1.00) shall be charged for each container or bag in excess of six. A fee of two dollars ($2.00) shall be charged for each container or bag in excess of twelve. A one dollar ($1.00) fee shall be charged for each container or bag of grass clippings or yard waste. Under no circumstances will grass clippings or yard waste be included in the six containers or bags of household garbage.
   (g)   Rubbish and trash and tree limbs and brush, too large to be placed in containers, must have special pick up arrangements made by contacting the Public Service-Safety Director. Additional changes will be made depending on weight and volume.
   (h)   No paint, paint thinners, alcohol byproducts, containers used with the foregoing products, or used automotive batteries will be collected in connection with the City rubbish collection service.

   (i)   From the time a resident places recyclable items at the curbside or street line for collection by City Service Department personnel, such recyclable items shall become the property of the City. It shall be a violation for any person unauthorized by the City to collect or pick up, or cause to be collected or picked up, any such item, and each such collection or pickup in violation hereof from any residence location shall constitute a separate and distinct offense punishable as a minor misdemeanor upon the first conviction and as a fourth degree misdemeanor for each succeeding conviction.

931.03 RATES AND TIMES OF PAYMENT.
   (a)   The City shall charge to every householder in a domestic premises within the City, except as hereinafter provided, the sum of eighteen dollars ($18.00) per month for the collection of garbage alone, rubbish alone or both garbage and rubbish, such sum being payable on or before the tenth day of the month after the end of the monthly period.
      (1)   Tenants of each rented domestic apartment unit located within the City who are responsible for payment of garbage and trash service only shall be required to pay in advance a fifty dollar ($50.00) nontransferable cash deposit.
      (2)   All householders in domestic premises and all tenants of rented domestic apartment units within the City, on a one pick-up per week basis, shall be limited to a maximum of six forty-five gallon containers or plastic bags of garbage and/or rubbish or fraction thereof.
   (b)   The City shall charge to every householder in a domestic premises within the City, who resides alone or who has attained the age of sixty-two years or more, and whose spouse or domestic partner has attained the age of sixty-two years or more, in a domestic premises the sum of twelve dollars ($12.00) per monthly period for the collection of garbage alone, rubbish alone or both garbage and rubbish, such sum being payable on or before the tenth day of the month after the end of the monthly period. To obtain the benefit of the reduced fee for a householder who resides alone, or who, together with his or her spouse or domestic partner has attained the age of sixty-two years or more, the householder must file with the City Water Department an application which shall include proof of age of the householder and spouse or domestic partner, and, if applicable, shall include a signed statement attesting to the fact that said householder resides alone. Any householder who consumes more than 500 cubic feet of water per month in each of three (3) consecutive months shall be presumed to be ineligible for the “residing alone” reduced fee, and said householder’s account shall be converted to a standard householder account at the rate of eighteen dollars ($18.00) per month. Any such householder may rebut this presumption by presenting satisfactory proof of the number of persons in the household and an explanation for the extraordinary water usage to the City Water Department. Likewise, any City resident householder who is one hundred percent (100%) disabled, and provides satisfactory proof of such disability, may file with the City Water Department office an application to receive a monthly rate of twelve dollars ($12.00) for collection of garbage alone, rubbish alone or both garbage and rubbish, such sum being payable on or before the tenth day of the month after the end of the monthly period for two years only.
   (c)   The City shall charge the operator of each commercial premises in the City the sum of a minimum of twenty-three dollars and fifty cents ($23.50) per month, for the collection of garbage alone, rubbish alone, or both garbage and rubbish, on a one pickup per week basis, such being payable on or before the expiration of ten days after the billing statement is deposited in the post office. For each additional pickup in any one week, commercial operators shall be charged an additional minimum charge of twenty dollars and fifteen cents ($20.15) plus a possible additional surcharge tied in to the volume of the pick-up to be determined and set at the discretion of the Public Service-Safety Director.
   (d)    For residents or resident businesses using City-owned dumpsters, the fees shall be as follows:
      (1)   For pickup once weekly, the monthly charge shall be:
            3 yd.   $65.50
            4 yd.   85.67
            6 yd.   131.00
      (2)   For pickup twice weekly, the monthly charge shall be:
            3 yd.   $131.00
            4 yd.    171.34
            6 yd.    262.00
      (3)   For any additional pickup on an as needed basis, not to exceed three (3) additional pickups in any three (3) month period, the fee shall be as follows:
            3 yd.   $ 15.62
            4 yd.    20.44
            6 yd.    31.23
   
   (e)   Each householder shall be sent a billing hereunder monthly.
   (f)    Each operator of a commercial premises shall be sent a billing hereunder monthly, such being payable within ten days after it becomes due.
   
   (g)    The charge to be made by the City for the use of the garbage and rubbish services to the subscribers of such services outside the City shall be one hundred percent (100%) over and above the usual charge for such services to residents of the City. Such additional charge shall be collected at the same time as the usual charge.
   (h)    On failure to pay the charges herein provided in the time herein specified, a ten percent (10%) penalty shall be added thereto.
