902.01 PROCEDURE FOR EXTENSION OF UNDERGROUND WIRING FOR STREET LIGHTING.
   (a)   Where an area, including the face of a street block, desires street lighting with underground wiring, a written petition signed by a majority of the property owners therein, together with a map of the area or street block face shall be filed with Council. The petition shall name an agent for the petitioners, shall recite that the petitioners will bear the total cost of the extension of the underground electrical wiring to the pole locations, which pole locations will be determined by the City in consultation with the electric power supplier.
   (b)   If Council determines that the petition of the property owners is satisfactory, it shall request the Public Service-Safety Director to obtain cost estimates from the electric power company.
   (c)   The Public Service-Safety Director upon receipt of the cost estimates shall notify Council and petitioners'agent of same.
   (d)   Upon notification of petitioners’ agent that the petitioners have the total estimated cost available for deposit with the City, Council, by resolution, may direct the Public Service-Safety Director to proceed with the underground wiring following his receipt from the petitioners'agent of the total estimated cost of installation. The City shall hold the deposit of money paid in for such purpose, and any sums not used in connection with such installation shall be retained by the City toward the defrayment of any future repair expense which may be incurred in connection therewith. If the original deposit shall prove to be insufficient to cover the initial cost of the installation of the underground electric wiring, or if additional expense is incurred in connection with future repairs to the system, the petitioners, their successors and assigns shall agree to deposit such additional sums as may be required by Council.
