901.02 STREET/ALLEY VACATION PROCEDURE.
   (a)   Petition Initiated Street/Alley Vacation.
      (1)   In addition to the required fee, a written letter of request shall be submitted to the legislative authority by the person who is seeking the street/alley vacation. Include description of length and width of street/alley to be vacated as well as street names involved. Letter shall have a phone number for contract purposes and original signature. No copies of the letter will be accepted.
      (2)   Petition shall be signed by all abutting property owners to authorize their approval for the proposed street/alley vacation. Petition must have all original signatures.
      (3)   Person shall submit a plat with highlighted lot numbers of the proposed vacation area.
      (4)   Person shall provide copies of all property deeds relating to property or properties in question.
      (5)   The Clerk of Council shall send a letter to each abutting property owner concerning the potential vacation of the alley and to each utility company, notifying it that the City intends to vacate a street or alley and that a permanent easement is held by the utilities per Ohio R.C. 723.041.
      (6)   Vacation plat drawing must include an area for approval by Bucyrus City Council by Ordinance Number with the passage date and signature of Clerk of Council. Drawing shall include a legal description of the plat.
      (7)   Notice of publication for six consecutive weeks is not required when written consent to such vacation is filed with the City by the owners of the properties abutting the proposed vacated street or alley.
   (b)   City Initiated Street/Alley Vacation:
      (1)   When, in the opinion of the legislative authority, there is good cause for vacating or narrowing a street or alley, or any part thereof, and that such vacation or narrowing will not be detrimental to the general interest, it may, by ordinance and without petition therefor, vacate or narrow such street or alley or any part thereof.
      (2)   The Clerk of Council shall send a letter to each abutting property owner concerning the potential vacation of the alley and to each utility company, notifying it that the City intends to vacate a street or alley and that a permanent easement is held by the utilities per Ohio R.C. 723.041.
      (3)   Notice of the vacation shall be published in a newspaper of general circulation for six consecutive weeks preceding action by the Municipality. Action thereon shall take place within three months after the completion of the notice.
      (4)   Vacation plat drawing shall include a legal description of plat that is in question. (Ord. 54-2008. Passed 12-2-08.)
