(a) Every out-of-door beer garden within the corporate limits of the City where beer or intoxicating liquor in any form whatosever is sold for on the premises consumption shall henceforth be completely enclosed by a durable fence not less than six feet in height, the same to be approved as erected by either the Chief of Police or by a duly authorized member of the City administration staff. Such erected enclosure shall have no less than two openings, each of which shall be no more than twelve feet in width and each of which shall be attended at all times when either beer or any other alcoholic beverage is being sold out-of-doors upon the premises, by at least one representative of the management to insure that all beer and alcoholic beverage containers shall be confined within the particular enclosed area.
(b) Whoever violates this section is guilty of a minor misdemeanor.
