A. Eligibility To Solicit: No charitable or not for profit organization or other person shall conduct solicitation activities on or within any of the street intersections within the Village, unless such organization shall be:
1. Registered with the Attorney General as a charitable organization in the manner provided by law.
2. Engaged in Statewide fundraising activities.
3. Liable for any injuries to any person or property during such solicitation activity which is casually related to an act of ordinary negligence of the soliciting agent.
4. Liable for any increase in the cost of liability insurance taken by the Village with respect to said street intersection solicitation activity.
5. Restricted in its solicitation activities to representatives or agents who shall be eighteen (18) years of age or more and who shall be wearing a high visibility vest, with no more than four (4) such persons being allowed to actually solicit on or within an intersection at any one time.
6. Able to first furnish a valid certificate of liability insurance with an insurer approved by the Village naming the Village as an additional insured with respect to such solicitation activities.
7. Able to first execute a hold harmless and indemnification agreement with the Village with respect to such solicitation activities. (1987 Code § 3-5-4)
B. Permission Required: Any organization eligible to conduct solicitation activities shall obtain permission for such solicitation from the Police Committee Chairperson. It shall be the duty of the Police Committee Chairperson to see that the applicant complies with eligibility requirements contained in subsection A of this section, and in addition, the Police Committee Chairperson must also find that the locations, times and durations of the proposed solicitation activity and the number of proposed solicitors shall not result in an interference with the flow of vehicular traffic or otherwise create a hazardous and unsafe condition at any such street intersection.
