9-10-2: AMENDMENTS TO REGULATIONS:
The Kankakee County subdivision regulations herein adopted are hereby amended as follows:
"Village" shall be inserted wherever the word "County" appears.
"Village Board" shall be inserted wherever the words "County Board" appear.
"Planning Commission" shall be inserted wherever the words "Planning and Zoning Committee" appear.
"Incorporated" is inserted wherever the word "Unincorporated" appears.
"Village Attorney" is inserted wherever the words "State's Attorney" appear.
The definition of Plat Officer in section 17-2 of said subdivision regulations is amended to read as follows:
 
Plat Officer
The Plat Enforcement Officer of the Village which shall be the Chairman of the Planning Commission.
 
Section 17-4(a)(2) is deleted and in lieu thereof the following provision is adopted:
Chairman of the Streets and Alleys Committee: The chairman of the Streets and Alleys Committee of the Village Board shall review with the Plat Officer and the Village Engineer all preliminary plats and make determinations concerning street and drainage design standards and engineering specifications as stipulated herein.
In section 17-24(b), the words "chairman of the Streets and Alleys Committee of the Village Board" are inserted where the words "Superintendent of Highways" appear.
Section 17-102 is deleted and in lieu thereof a new provision entitled Review Procedure is inserted as follows:
      1.   All appeals shall be made to the Appeals Board to which the developer shall submit his proposal to the Board and they shall determine the feasibility of the variation requested and its effect on the total project.
      2.   After hearing the case, the Board shall submit a report to the Planning Commission and recommend either:
         a.   Acceptance;
         b.   Acceptance with modification;
         c.   Acceptance with restrictions;
         d.   Rejection.
Upon receipt of the Board's recommendation, the Commission shall reconsider the plan, and make its own recommendation to the Village Board. The final plat should then be prepared as provided for in this Chapter.
      3.   The Plat Officer shall arrange a meeting of the Appeals Board to be held within thirty (30) days of the Commission's official decision to allow a hearing on the proposed variation. The developer shall prepare documentation for his case and present six (6) copies, in detail, to the Plat Officer no less than ten (10) working days prior to the appeals hearing. The Plat Officer shall distribute the copies to the members of the Board and shall retain one copy for the Board files. The Board may then hear the case as it is presented by the developer or his agent. After hearing the case and asking questions relative to the case, a member of the Board may present a recommendation to floor. Following any discussion, a polling of the Board shall be taken by the chairman. A simple majority of those present shall be considered as approval of the recommendation, but, if it is so desired by the Board, a majority report and a minority report may be forwarded to the Planning Commission for their consideration at their next scheduled committee meeting.
