A. Permit Required: No new construction or building shall be permitted within the Village limits, and no new additions to, improvements on or replacements of existing buildings or structures shall be permitted within the Village limits unless the person responsible for said construction or building, or the owner of the property upon which the construction or building is to be erected, added or replaced, or both, shall first obtain from the code enforcement officer as appointed by the Village Board of Trustees a permit authorizing the contemplated construction, addition or replacement.
B. Application For Permit: Any person desiring to so construct or build a new building or structure or to add to, alter, improve or replace an existing building within the Village limits shall first file with the code enforcement officer or, in the event the position of code enforcement officer is vacant, Chair of the Planning and Zoning Committee an application for permit, together with such fees as are hereinafter prescribed, which application shall contain:
1. Detailed plans and specifications of the proposed construction, addition, improvement, or replacement.
2. A sketch showing the location of the proposed construction, addition, improvement or replacement upon the lot or lots on which the same is to be made and, in particular, showing the distance of the proposed construction from the lot lines involved.
3. The use or purposes for which the proposed construction is intended; whether a residence, garage or business property; and if a residence, specifying the number of families to be housed therein, or if a business building, the type of business to be conducted therein.
4. The name and address of the owner of record of the lot or lots upon which the proposed construction is to be placed and the consent of such owner to such proposed construction, provided the application is submitted by any person other than said owner.
5. The name and address of the person who is to perform the proposed construction, together with an estimate of the reasonable costs of such proposed construction.
C. Construction Requirements: Upon submission of any application for permit to the code enforcement officer as hereinbefore provided, such permit shall be granted in accordance with the terms of the application, provided the application shows that the proposed construction will comply with the following:
1. Floor Area: All new construction, including replacements of existing structures for residential purposes, shall contain a minimum of seven hundred fifty (750) square feet of floor space for a single-family dwelling and one thousand five hundred (1,500) square feet for a multi-family dwelling, breezeways, porches, garages and basements excluded.
2. Location:
a. Except as herein provided, no construction, addition, improvement or replacement shall be located nearer than five feet (5') to the side lot lines nor ten feet (10') to the front and back lot lines, provided construction is contemplated on one lot, and further provided, that where the proposed construction is to be located on more than one lot, the above setbacks shall apply to the outer lot lines of the lots involved.
b. In the event the proposed construction is to be used as a garage, said construction shall be not nearer than five feet (5') to the side lot lines and ten feet (10') to the front lot line.
c. In the event the proposed construction is to be used for business purposes and in the event the application shall contain a request for variation in the above restrictions, the Board of Trustees may, in its discretion, allow such variation, which shall be in compliance with subsection 10-3A-5
C of this Code.
3. Number Of Buildings Per Lot: No new building intended for residential living shall be constructed on any lot upon which a building intended for residential living is already located.
4. Animal Shelter: No construction intended for or used solely for the maintenance, housing or care of animals and livestock, ordinary house pets excepted, shall be permitted.
D. Each application for permit shall be approved or denied by the code enforcement officer based on its satisfactory compliance with all adopted building codes, Village ordinances, and State statutes. Appeals for denials shall be heard by the Village Board of Trustees at their regularly scheduled meeting and a final determination shall be made by the Village Board of Trustees.
