(a) Definitions.
(1) Parklet - An area extended from the existing public sidewalk into an adjacent on street parking stall to provide additional seating and amenities for adjacent businesses.
(2) Right-of-Way - The line between a lot, tract, or parcel of land and a contiguous public street, and demarcating the public right of way.
(b) Types of Permits; Prohibition.
(1) Parklet permit. A permit allowing for a parklet to be placed within an existing on-street parking stall.
(2) Services in Right-of-way. Nothing in this chapter should be construed to preclude the City of Bryan from requiring any person offering any natural gas, electric, cable television, telecommunications or other utility services, for which the City may lawfully require a franchise, to acquire a franchise upon the expiration of any right-of-way occupancy permit issued hereunder.
(c) Criteria for Granting Permits.
(1) A parklet permit application form must be adopted by the City of Bryan and provided to all permit petitioners. Parklets shall not be placed without an approved permit from the City of Bryan.
(2) A permit holder shall be granted access to parking stalls as designated under a permit and licensing agreement and the permit holder shall be responsible for all maintenance, personal and property liability damages and shall hold the City harmless therefrom.
