145.01 POLICY CONCERNING THE AVAILABILITY OF PRODUCTS AND SERVICES OF MUNICIPAL UTILITIES.
   (a)   It is hereby declared to be the policy of the City, to make available the products and services of its municipal utilities to all residents of the City, in accordance with such rates, rules, regulations and other terms and conditions of service as are now, or may hereafter be, adopted by the Board of Public Affairs, at reasonable rates and without unjust discrimination among the customers served, taking into account their situation and classification.
   (b)   There is presently no provider of electric or water utility services other than the City of Bryan Municipal Light and Water Utilities, that is authorized by the City under Article XVIII of the Ohio Constitution, or otherwise in accordance with the laws of the State, to provide such services within the corporate limits of the City.
   (c)   Nothing in this section is to be construed to limit either the authority of the Bryan Board of Public Affairs as established by the City Charter, or the right of the City of Bryan to make available, sell and deliver the surplus product or service of its municipal utilities outside of its corporate limits in accordance with Article XVIII, Section 6 of the Constitution of Ohio.
   (d)   The Board of Public Affairs, acting by and through its Director of Utilities, and the City Attorney are hereby authorized and directed to take all such measures as may be necessary and appropriate to implement this section, including the retention and engagement of the services of such outside counsel and consultants as they may deem necessary or appropriate for such purposes.
