1319.03 PENALTIES.
   Any person, partnership or corporation, whether as principal agent, employee or otherwise, who violates any provision of this Part Thirteen – Building Code for which no other penalty is provided shall be fined not more than five hundred dollars ($500.00). Other penalties include:
   (a)   Violations of the Permit Requirements. Whoever violates any part of Chapter 1309 shall be guilty of a minor misdemeanor and shall be fined not more than ($100.00).
   (b)   Violations of the Ohio Building Code. Whoever violates any provision of Chapter 1321, Ohio Building Code adopted herein or fails to comply with any lawful order issued pursuant thereto is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand ($1,000), or imprisoned not more than six months or both.
   (c)   Violations of the NFPA 70 National Electric Code. Whoever violates any provision of Chapter 1325, the NFPA 70 National Electric Code as adopted herein or fails to comply with any lawful order issued pursuant thereto is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand ($1,000), or imprisoned not more than six months or both.
   (d)   Violations of the Residential Code of Ohio for One, Two and Three Family Dwelling. Whoever violates any provision of Chapter 1329, Residential Code of Ohio for One, Two and Three Family Dwelling, as adopted herein or fails to comply with any lawful order issued pursuant thereto is guilty of a misdemeanor of the first degree and shall be fined not more than one hundred dollars ($100.00). In addition to any other remedies provided by this Code for its enforcement the City may bring civil suit to enjoin the violation of any provision of the Residential Code of Ohio for One, Two and Three Family Dwelling.
   (e)   Violations Regarding Unsafe Structures. Whoever violates any provision of Chapter 1355 shall upon conviction thereof be subject to a fine of not more than one thousand dollars ($1,000.00) or imprisonment for a term not to exceed six months, or both, at the discretion of the court.
   (f)   Each Day a Separate Offense. Each day during which a violation continues shall constitute a separate offense. The City may institute injunction proceedings in Common Pleas Court to abate the nuisance of failure to cease work after receipt of a stop work order as referred to in Section 1319.01.
