(a) Request for Sidewalk Variance. If an owner of a lot or parcel of land in the City is repairing or replacing an existing sidewalk or is installing a new sidewalk, he may petition in writing to the Bryan City Engineer for a variance to the requirements of Sections 903.02 to 903.06. The Planning Commission shall then determine if the proposed variance should be granted. The applicant may appeal the denial of the proposed variance to Council.
(b) Conditions for Granting of Variances.
(1) Special conditions and circumstances must exist which are peculiar to the proposed replacing or installation of sidewalks.
(2) The special conditions and circumstances are not created solely by the applicant.
