901.02 STREET OPENINGS, PERMIT AND FEE.
   (a)   Before any person other than a duly authorized City officer or employee, makes any opening in or tunnels under any street, boulevard, avenue, alley, highway or other public grounds in the City, or removes the surface of any sidewalk or any part thereof, or opens any sidewalk in the City, such person shall file with the City Engineer a written or printed application therefor, setting forth and accurately indicating therein the location, kind and extent of the proposed opening or removal of sidewalk, the number, purpose and size of the openings or excavations which are desired or necessary, and shall obtain a permit to perform such work. The applicant shall pay to the Clerk-Treasurer a permit fee of twenty dollars ($20.00) and shall also deposit with the Clerk, an additional two hundred dollars ($200.00) or ten dollars ($10.00) per square yard of the proposed excavation, whichever is greater, to cover the cost and supervision of backfilling, repairing, restoring and relaying the pavement or hard surface or the sidewalk, as the case may be, together with the cost of any new material, as the same shall be estimated by the City Engineer.
   (b)   No person shall engage in any type of excavation within or in close proximity (as set forth in the excavation regulations) to street trees (as defined in Codified Ordinance Section 901.01) before conferring with the City Arborist and obtaining an excavation permit.
