(a) Whoever violates any of the provisions of Section 1462.18 or 1462.20(a) may be cited by issuance of a waiver ticket at the time and place, or in the vicinity of, the observation of such violation by any member of the Division of Air Pollution Control trained to make such observations. Upon the refusal of the person cited to accept the waiver ticket, such member shall note the refusal on his record and proceed, as in other violations, to cause an affidavit and warrant to be issued.
(b) No waiver ticket shall be issued to any person who has been cited two or more times in the preceding twelve months.
