The provisions of this Air Pollution Code shall not apply to any combustion device erected, constructed, altered or installed in any one or two-family dwelling that is not used for commercial purposes or for a retail business or that has not more than one retail establishment attached thereto or included therein, provided such retail establishment is the secondary or incidental function of the building or serves not more than two dwelling units. The provisions of this Air Pollution Code shall not apply to the erection, construction, alteration, installation or inspection of any warm air furnace, unit heater, direct-fired unit heater or ceiling-type unit heater. However, if the operation of such equipment violates Section 1462.18, and if a complaint is received, the Division of Air Pollution Control shall abate such violation.
