1444.13 TIME, FEE AND NOTICE OF APPEAL.
   (a)    An appeal of any decision of the Chief Building Official or designee arising from the Chief Building Official's or designee interpretation of the Building Code may be made within thirty (30) days from the date of the decision from which the appeal is taken by paying the required $125.00 and filing with the Chief Building Official or designee and with the Board, a notice of appeal, specifying the grounds therefor. The Chief Building Official or designee shall forthwith transmit to the Board, papers upon which the action appealed was taken. Should the majority of the Board vote to overrule the Chief Building Official's or designee interpretation, the filing fee shall be refunded to the aggrieved. In no case shall a refund be made arising from a variance of the Building Code.
   
   (b)    A request for a variance from the Building Codes may be made within thirty (30) days from the date of the decision from which the variance is requested by paying the required $125.00 and filing with the Chief Building Official or designee and with the Board, a request for variance application, specifying the code section(s) the request for variance is being applied for; along with the other pertinent information essential to make a determination.
