1440.20 NONLIABILITY OF CHIEF BUILDING OFFICIAL AND INSPECTORS.
   In accordance with and subject to Ohio R.C. Chapter 2744, the Chief Building Official or designee, acting in good faith and without malice, in the discharge of his or her duties, shall not render himself or herself personally liable for any damage that may accrue to persons or property as a result of any act or by reason of any act or omission in the discharge of his or her duties. Any suit brought against the Chief Building Official or designee or employees of the City because or such an act or omission performed in the enforcement of this Building and Housing Code, or the Planning and Zoning Code, shall be defended by the City to the extent required under Ohio R.C. Chapter 2744 until final determination, and any judgment thereon shall be assumed by the City. The Development Director/Chief Building Official or his or her authorized representative(s) shall not be liable for costs in any action, suit or proceeding that is instituted in pursuance of the provisions of the Building and Housing Code or the Planning and Zoning Code. This Code shall not relieve or lessen the responsibility of an owner, operator or controller of a building or structure for any damage to any person or property caused by defects, nor shall the Division of Permits and Inspections or the City to be held to assume any such liability by reason of inspections or permits authorized by this Code.
