1420.01 ONE, TWO AND THREE FAMILY DWELLING CODE ADOPTED; PURPOSE.
   (a)   Pursuant to Ohio R.C. 731.231 and 3781.10(H), there is hereby adopted by and for the Municipality, for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of one two and three-family dwellings and their accessory structures, “The Ohio Residential Code for One, Two and Three-Family Dwellings” promulgated by the Ohio Building Officials Association (OBOA) and the International Code Council, Inc. (ICC), save and except such portions as may be hereinafter deleted, modified or amended, which Code is incorporated as fully as if set out at length herein, and from the date on which this section takes effect, the provisions thereof shall be controlling in the construction of one, two and three-family dwellings and their accessory structures in the City.
   (b)   The purpose of “The Ohio Residential Code for One, Two and Three-Family Dwellings” is to provide minimum requirements to safeguard life, limb, health and the public welfare, and to protect property as it relates to these safeguards by regulating and controlling the design, construction, prefabrication, equipment or appliance installation, quality of materials, use, occupancy, location and repair of detached one-family, two-family or three-family dwellings, not more than three stories in height. Further, the purpose is to standardize requirements by using a compilation of data from national model codes.
   (c)   “The Ohio Residential Code for One, Two and Three-Family Dwellings”shall be deemed to accomplish the purpose of the mandate of the Ohio legislature and to standardize building regulations, and encourage uniform application and interpretation for the benefit of the construction industry, building department personnel, and the general public.

   (d)   Permit applicants may use, at their choice, either the Brunswick Dwelling House Code or The Ohio Residential Code for One, Two and Three-Family Dwellings until December 31, 2004.
   As of January 1, 2005, only the Ohio Residential Code for One, Two and Three-Family Dwellings may be used.
