(a) No person shall without privilege to do so, knowingly mark, deface, disfigure, injure, tamper with or displace railings, paving or paving materials, water lines or other public utility or parts, or appurtenances thereof, signs, notices or placards (whether temporary or permanent), monuments, stakes or other boundary markers or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal.
(b) Whoever violates this section is guilty of a misdemeanor of the third degree. If violation of this section creates a risk of physical harm to any person, it is then a misdemeanor of the first degree. Punishment shall be as provided in Section 698.02.
