660.05 DUTY TO KEEP SIDEWALKS IN REPAIR AND CLEAN.

(a) No owner or occupant of abutting lands shall fail to keep the sidewalks, curbs or gutters in repair and free from snow, ice or any nuisance.
(ORC 73.011)

(b) For the purpose of this section, a sidewalk shall be considered free from snow and/or ice when an eighteen inch path has been cleared from the sidewalk.

(c) An accumulation of snow and/or ice of six inches or more shall be prima-facie evidence of failure to keep the sidewalks free from snow and/or ice.

(d) The enforcement of this section is primarily the responsibility of the Division of Permits and Inspections, under the Department of Public Service.

(e) Whoever violates this section is guilty of a minor misdemeanor. Punishment shall be as provided in Section 698.02.
