§ 51.090 INJUNCTIVE RELIEF.
   (A)   When the Superintendent finds that a user has violated, or continues to violate, any provision of this chapter, a wastewater discharge permit, or an order issued hereunder, the Superintendent may petition a court of competent jurisdiction, on behalf of the town, under I.C. 36-1-6-4, for the issuance of a temporary or permanent injunction, as appropriate, which restrains the alleged violation or compels the specific performance of the wastewater discharge permit, order, or other requirement imposed by this chapter on activities of the user.
   (B)   The Superintendent may also initiate any other action for any available legal and/or equitable relief, including imposition of civil penalties or a requirement for the user to conduct environmental remediation. A petition for injunctive relief shall not be a bar against, or a prerequisite for, taking any other action against a user.
