§ 51.026 DETERMINATION OF WASTEWATER STRENGTH FOR RATE PURPOSES.
   (A)   The strength of wastewaters discharged by a user to the sewage works shall be determined, for periodic establishment of charges provided for in §§ 51.065 through 51.071 from samples taken at the user’s established sampling location at any time, and of a duration and in a manner as the town may elect, or at any alternative sampling location mutually agreed upon between the user and the town. Appropriate charges for sampling and analysis may be assessed to the user at the option of the town. The results of routine sampling and analysis by the user may also be used for determination of charges after verification by the town.
   (B)   The discharge of sanitary wastewaters to the sewage works at levels more than 10% above normal domestic waste strength for any of the parameters of carbonaceous biochemical oxygen demand, suspended solids, ammonia, or phosphorus may become subject to surcharge to rates otherwise applicable under the §§ 51.065 through 51.071 as a result of rate studies to be performed by the town under §§ 51.065 through 51.071.
   (C)   The discharge of industrial wastes to the sewage works with any pollutant at a concentration above those specified in § 51.020(D), if permitted by the Superintendent, may become subject to surcharge to rates otherwise applicable under §§ 51.065 through 51.071 as a result of rate studies to be performed by the town under §§ 51.065 through 51.071.
