§ 34.01 RESERVE OFFICERS.
   (A)   As authorized by the provisions of I.C. 36-8-3-20, police reserve officers may be appointed in the same manner and by the same authority that appoints the regular members of the Police Department.
   (B)   The name of the police reserve shall be the “Brownstown Police Reserve”.
   (C)   The number of the police reserve officers shall be fixed by the Town Council.
   (D)   Police reserve members may not be members of the regular Police Department but have all the same powers as regular members, except as limited by the rules, regulations, and directives of the Police Department and the Town Council. Such limitations may be imposed collectively or individually. The Town Marshal, subject to the approval of the Town Council, may adopt whatever rules, regulations, and directives from time to time as deemed appropriate to govern the activities of police reserve officers, and may limit the authority of each such police reserve officer as deemed appropriate, including the limitations of the geographical area in which such police powers may be exercised.
   (E)   To the extent that money is appropriated for a purpose listed in this section, police reserve officers may receive any of the following:
      (1)   A uniform allowance;
      (2)   Compensation for time lost from other employment because of court appearances at the rate of 150% of federal minimum wage; and
      (3)   Insurance for life, accident, and sickness coverage.
   (F)   Police reserve officers are not eligible to participate in any pension program provided for regular members of the Department.
   (G)   A police reserve officer may not be appointed until he or she has completed the training and probationary period specified by rules of the Department.
      (1)   The Town Marshal, subject to the approval of the Town Council, shall fix the prerequisites of training, education, and experience for police reserve officers, subject to certain minimum requirements prescribed herein.
      (2)   Applicants must:
         (a)   Be 21 years of age or over;
         (b)   Never have been convicted of a felony, or a misdemeanor;
         (c)   Be of good moral character;
         (d)   Have sufficient training to insure the proper performance of their authorized duties; and
         (e)   Set out in writing their personal acknowledgment that as a reserve officer they serve at the express pleasure of the Town Marshal and the Town Council, and that the individual’s commission as a reserve officer may be revoked by the Town Marshal and the Town Council for any reason or for no given reason at all at any given time.
   (H)   A police reserve officer may not do any of the following unless the police reserve officer successfully completes a pre-basic course under I.C. 5-2-1-9(f):
      (1)   Make an arrest;
      (2)   Conduct a search or a seizure of a person or property; or
      (3)   Carry a firearm.
   (I)   The payment of the costs of the pre-basic course shall be the sole responsibility of the police reserve officer.
   (J)   A police reserve officer may be covered by the medical treatment and burial expense provisions of I.C. 22-3-6 and I.C. 22-3-7. If compensability of an injury is an issue, then administrative procedures of I.C. 22-3-6 and I.C. 22-3-7 shall be used to determine the issue.
